Miller exonerated in Kona robbery, assault

On Dec. 26, 2012, at a continued preliminary hearing, Kona District Court Judge Joseph P. Florendo, Jr., dismissed the charges of first degree robbery, first degree assault and third degree theft against Alexander Palani Miller.

The dismissal was based on a written motion submitted by the prosecutor and announced by Miller’s attorney, Robert D.S. Kim.

The stated grounds for the dismissal, made to the court, was that the state could not prove its case based on the confession of Kainoa Bryan.

Miller had been charged with robbery, assault and theft involving a Nov. 26, 2012 incident in Kona. News of the arrest of Miller and charges he faced, were covered by local media outlets across the state.

Kim said, “We received police reports and video tapes revealing that Kainoa Bryan had confessed that he and others had been involved in the incident to detectives. Bryan stated that Alexander Miller was not there, and that he (Bryan) was the African-American male that attacked the victim.

Miller had been held in custody for 18 days, unable to post bail.

“Miller’s family is relieved that this nightmare is over,” Kim said, “and hope that he will be able to now clear his name with this dismissal.”
